How is a US LLC taxed for an Indonesian founder?
Indonesia has a US income tax treaty in force. Indonesian tax residents are taxed on worldwide income and report foreign holdings on the annual SPT, so the LLC sits inside your domestic position.
Where Indonesia stands
Verified July 28, 2026
Indonesia appears on the IRS index of countries with a US income tax treaty in force.
Indonesian tax residents are taxed on worldwide income and report foreign holdings on the annual SPT.
We could not locate an authoritative source for a specific declaration threshold analogous to Brazil's CBE, or for how CFC rules treat an individual LLC member.
A foreign-owned single-member LLC generally must file Form 5472 with a pro-forma 1120, whether or not tax is owed.
Provider country policies change without public notice — Mercury revised its prohibited list in 2024 and has amended it since. Treat this page as a starting point that was accurate on the date shown, then check the provider's own page before you apply. We would rather you verify us than trust us on something this consequential.
The treaty is real; the exemption people imagine is not
Indonesia is on the IRS treaty index, which puts Indonesian founders ahead of markets with no treaty at all. What a treaty does is allocate taxing rights and reduce certain withholding. It does not remove worldwide-income taxation for an Indonesian tax resident, and no formation structure does.
The export-proceeds rules are not your rules
You will see the DHE SDA regime cited on formation sites as though it constrains every Indonesian exporter. Government Regulation No. 21 of 2026, effective 1 June 2026, applies to natural-resource exports — not to software or services. If you run a SaaS or agency business, citing it at you is either carelessness or padding.
What we could not establish
We found no authoritative source for a mandatory foreign-asset declaration threshold comparable to Brazil's CBE, nor for how Indonesia's controlled-foreign-company rules apply to an individual member of a US LLC. Rather than publish a plausible number, we are marking it unverified and pointing you at an Indonesian tax adviser.
Worth knowing before you buy
One of the four rows above is explicitly unknown, and it happens to be the reporting question most founders will care about. RazorFile is not a tax adviser and nothing here is advice. Ask an Indonesian adviser about declaration thresholds specifically.
Common questions
Does the treaty mean I pay no Indonesian tax?
No. Indonesian tax residents are taxed on worldwide income. The treaty allocates taxing rights and can reduce certain withholding, but it does not exempt foreign income from Indonesian tax. Anyone framing a US LLC as an exit from Indonesian tax is describing something the treaty does not do.
Do the export-proceeds rules apply to my software business?
The DHE SDA regime applies to natural-resource exporters, not to software or services. Some formation sites cite it loosely as though it covers everyone. For a SaaS or agency founder it does not.
What do I have to declare in Indonesia?
Indonesian tax residents report worldwide income on the annual SPT, and foreign holdings form part of that picture. We could not verify a specific declaration threshold for foreign assets, so we will not quote one. Confirm with an Indonesian tax adviser.
